Declaration of identity (identity of China ID & HK ID)

This is one of the most common used documents in China recently. When a China resident is allowed to move to Hong Kong, but the domestic real estate, bank account, social insurance, driving license, etc. registered with a China ID card, it is necessary to come before a China Appointed Attestation Officer to make a declaration stating that China ID & HK ID belongs to the same person.

Documents you have to provide:
HKID card
China entry permit
Copy of China ID card or other documents showing the China ID number will also be accepted

Declaration of Family Members

Since the “One Property Policy” has taken effect in Mainland China, the Purchaser or the Vendor have to provide a “Declaration of Family Member” to prove his/her family own only one property in China only when purchasing or selling property in China upon request by the government regional real estate department, so as to enjoy tax benefit.

Members in a family include the husband and wife, and child/children under 18-year old. A Declaration can be
made by either the husband or the wife, or both, which depends on the requirements of the relevant departments.

For the declarant whom the marital status is single, a “Certificate of Absence of Marriage Record” (i.e. Prove that he/she is single) is compulsory, to be obtained from the Marriage Registration and Records Office in Hong Kong.

For the declarant who’s marital status is divorced, Marriage Certificate and Divorce Certificate of former marriage, and the “Certificate of Absence of Marriage Record” have to be provided.

For the declarant whom the marital status is widower/widow, Marriage Certificate of former marriage and the
Death Certificate of the late spouse are necessary. Also, the “Certificate of Absence of Marriage Record” is necessary as well.

Documents you will need to provide:
1. Hong Kong Identity Card and China Entry Permit;
2. Spouse’s Hong Kong Identity Card;
3. Marriage Certificate;
4. Personal documents of the child/children (Including Birth Certificate, Hong Kong Identity Card, China Entry Permit, Hong Kong Re-entry Permit)
5. For the singles, provide the “Certificate of Absence of Marriage Record” which issued by the Marriage
Registration and Records Office;
6. Real Estate Certificate or Agreement for Sale and Purchase if the property has been purchased has to be
produced, too.

Marriage Registration in Mainland China

Firstly, please apply the “Certificate of Absence of Marriage Record” with the Marriage Registration and RecordsOffice. If you had married in Hong Kong before, the Marriage Registration and Records Office will not issue theaforesaid certificate to you and a “Letter of marriage record” will be issued instead.

Please come to our solicitors’ firm to make a Declaration of Marriage Application together with your “Certificate of Absence of Marriage Record” or the “Letter of marriage record”. Meanwhile, you will have to produce your HKID Card and China Entry Permit.

To ensure the particulars of your fiance/fiancee (including full name, date of birth, domicile address (and/or
present living address)) are correct, please provide his/her Mainland Identity Card and/or Household Register
Book.

If you have got married and divorced in Hong Kong, please provide us the original or certified copy of your
Marriage Certificate and the Divorce Certificate of the former marriage.

If you have get married and divorced in Mainland or Overseas, please provide us the original of your Divorce
Certificate of the former marriage (Attested by the Embassy of China in relevant country will be necessary in case
of Overseas document).

If you are a widower/widow, please provide the original of Death Certificate of the late spouse.

Documents you will need to provide:
1. Hong Kong Identity Card;
2. China Entry Permit;
3. “Certificate of Absence of Marriage Record” issued by the Marriage Registration and Records Office;
4. (If applicable) Original or certified copy of Marriage Certificate;
5. (If applicable) Original or certified copy of Divorce Certificate and/or Death Certificate of the late spouse.
